Hospital Visitors: Hospital Not Liable For Fainting Watching Nasogastric Tube Insertion

 

   Quick Summary: When a family member is watching, the hospital has the legal responsibility to inform the family member what procedure is about to be performed. At that point the danger of becoming queasy or fainting if the family member stays and watches is open, obvious and known to the family member, according to the Court of Appeals of Kansas, and the hospital has no duty to warn the family member he or she may have an adverse reaction.
